Picketing Dos and Don'ts

Picketing Do’s

• Maintain order.
• Keep moving.
• Keep assigned schedule.
• Report problems to captain with names, license #s.
• Obey police.
• Chant, sing and speak with one voice.
• Be courteous to all but those who scab your work.
• Thank those who support you.

Picketing Don’ts

• Incite violence.
• Litter.
• Loiter.
• Drink alcohol.
• Destroy or damage property.
• Engage in acts of harassment.
• Make unauthorized statements to police or journalists.
• Block egress.

Picket Line Misconduct

• Employees who engage in picket line misconduct may lose their right to reinstatement.
• Test is whether the conduct “reasonably tends to coerce or intimidate employees in the exercise of their rights”.
• Words alone may be sufficient.

Misconduct directed at employees

• Misconduct by strikers may preclude their reinstatement when the misconduct is directed at particular employees.
• Five car loads of people visiting a non-striking worker’s home to discuss joining the strike may be unprotected activity.

Consequences

MISCONDUCT CAN RESULT IN A COURT ORDER SEVERLY LIMITING AND RESTRICTNG PICKETING LOCATIONS AND REDUCING THE NUMBER OF PICKETER ALLOWED AT EACH LOCATION
